Excess proceeds from the sale of tax-defaulted property is defined as any amount that exceeds one hundred fifty dollars ($150.00) after taxes, assessment liens, and costs of the sale have been satisfied.
The California Revenue and Taxation Code, Section 4675 states, in part (paraphrased): Parties of Interest and their order of priority are:
- First, lien holders of record prior to the recordation of the tax deed to the purchaser in the order of their priority.
- Then, any person with title of record to all or any portion of the property prior to the recordation of the tax deed to the purchaser.

An individual has the right to file a claim for excess proceeds on his or her own behalf, directly with the County of Madera.
Claims must be received by the close of business day, within one year of the date the deed to purchaser was recorded.
A Madera County Claim Form must be used.
Should the claim be approved, the Auditor-Controller will issue a county warrant 90 days after the approval from the Board of Supervisors. For additional information, please review the Madera County Policy Regarding the Submission of Claims for Excess Proceeds.
